Article 1 – Definitions & Role of Job Heroes

Job Heroes (“Job Heroes”, “we”, “us”, “our”) provides a recruitment marketing service and platform (dashboard) through which employers can acquire candidates (“Leads”) via online advertising campaigns (including Meta and LinkedIn).

Job Heroes:

• recruits candidates through campaigns

• collects candidate data

• makes this data available to the client through the Job Heroes dashboard

Job Heroes is not a temporary employment agency, recruitment agency, or executive search firm, and does not enter into employment agreements on behalf of clients or candidates.

Article 2 – Services

The services provided by Job Heroes consist of:

• setting up and managing online advertising campaigns

• collecting candidate responses (leads)

• making leads available in the Job Heroes dashboard

Job Heroes does not guarantee employment placements, job interviews, or the hiring of candidates.

Article 3 – Clients & Payment

Clients pay for the number of leads delivered, not for the final hiring result.

A lead is considered valid once a candidate has actively submitted their information through a campaign managed by Job Heroes.

Article 4 – Advance Payment & Acceptance of the Quotation

Job Heroes will only commence the execution of its services after the agreed fee has been paid in full following receipt of the quotation.

Payment shall be considered final acceptance of the quotation, including:

• the agreed scope

• the agreed number of leads

• these Terms & Conditions

• the Privacy Policy

Upon receipt of payment, execution of the services will commence immediately.

Article 5 – Dashboard & Access

Job Heroes provides a dashboard through which clients can view leads. The client is solely responsible for:

• proper handling of personal data

• compliance with GDPR when contacting candidates

• secure storage of exported data

Job Heroes provides a dashboard through which clients can view and manage leads.

Through the dashboard, the client has the ability to communicate with delivered leads using the functionalities made available by Job Heroes.

Access to the dashboard and communication capabilities with leads are subject to the following conditions:

• The client may actively communicate with delivered leads through the dashboard for a period of four (4) weeks following the end of the campaign.

• After this period, the dashboard will remain available for viewing purposes, but for a maximum period of twelve (12) months after the campaign has ended, the client may only consult existing lead data.

• After this twelve (12) month period has expired, Job Heroes may restrict or terminate access to (parts of) the dashboard and the lead data contained therein, unless otherwise agreed or legally required.

The client remains solely responsible at all times for GDPR compliance in relation to the use of the dashboard and communication with leads.

Article 6 – Responsibility for Candidate Communication

Job Heroes:

• does not conduct selection interviews

• does not engage in substantive communication regarding vacancies

• does not make decisions regarding suitability or hiring

All follow-up regarding leads is carried out entirely under the responsibility of the client.

Article 7 – Use of Data & Content

Data provided by Job Heroes may only be used for recruitment purposes within the scope of the agreed assignment.

It is prohibited to:

• reuse data for other purposes

• sell or share data with third parties

Article 8 – Intellectual Property

All rights relating to the Job Heroes platform, dashboard, campaign structures, texts, visuals, and software remain the property of Job Heroes/ Advertising Heroes, unless otherwise agreed in writing.

Article 9 – No Guarantee & Liability

Job Heroes provides a best-efforts obligation and not a results obligation.

Job Heroes shall not be liable for:

• lack of responses from candidates

• the suitability of candidates

• decisions made by clients or candidates

Liability is limited to the amount paid by the client for the relevant campaign.

Article 10 – No Right to Refund

As the services of Job Heroes are executed immediately after payment and involve costs (such as advertising spend, campaign setup, and data processing), there is no right to a refund of amounts already paid.

Paid amounts shall not be refunded, regardless of:

• whether or not leads are contacted

• the outcome of interviews

• the hiring of candidates

• early termination by the client

Refunds are only possible if Job Heroes demonstrably and entirely fails to perform the agreed services.

Article 11 – Termination

Job Heroes reserves the right to terminate accounts or campaigns in the event of misuse, violation of these terms, or violation of applicable laws and regulations.

Article 12 – Governing Law

These Terms & Conditions are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.

Article 13 – Identity of the Service Provider

Job Heroes is a service of  Advertising Heroes. All agreements concluded through Job Heroes are entered into with Advertising Heroes.

Article 14 – 100% Candidate Guarantee

Job Heroes guarantees the generation of candidate responses, not the establishment of an employment agreement, placement, or successful match.

If no candidate responses are generated through the campaign set up by Job Heroes during the agreed campaign period, the client shall be entitled to a refund of the campaign fee paid to Job Heroes (excluding the advertising budget), provided the conditions set out in this article are met.

Job Heroes expressly does not guarantee:

• the suitability, qualifications, or availability of candidates;

• the level of motivation or experience;

• whether a personal connection arises between the client and candidate;

• the successful filling of a vacancy or the establishment of an employment relationship.

The assessment of candidates, conducting of interviews, and hiring decisions remain entirely the responsibility of the client.

The candidate guarantee only applies if:

• the client provides all required information in a timely and complete manner;

• the vacancy has been assessed in advance by Job Heroes as realistic and feasible;

• the campaign has run for at least the agreed duration and media budget;

• candidates are followed up by the client in a timely and professional manner.

The candidate guarantee shall lapse if:

• one or more candidate responses have been generated;

• candidates are rejected by the client for subjective reasons such as personal preference, chemistry, or company culture;

• the client fails to follow up with candidates, fails to do so in a timely manner, or fails to do so substantively;

• the campaign is terminated prematurely.

Refunds apply exclusively to the campaign fee invoiced by Job Heroes and exclude external advertising costs and work already performed.

Privacy Policy (GDPR)

1. Who We Are

For the processing of personal data through Job Heroes,  Advertising Heroes acts as the data controller.

2. What Personal Data We Process

We may process the following personal data, depending on what a candidate submits and how the campaign is configured:

• name

• contact details (telephone number, email address)

• work-related information (for example experience or availability)

• information from CVs or answers to questions (where applicable)

• technical data (IP address, device/browser, campaign and interaction data)

3. Purposes of Processing

We process personal data for:

• collecting and delivering leads to the client for whom the candidate responds

• managing and improving campaigns and the platform

• security, fraud prevention, and abuse detection

• compliance with legal obligations

4. Legal Bases

We process personal data based on:

• consent (where applicable)

• performance of a contract or pre-contractual measures (for example at the request of the data subject)

• legitimate interest (such as executing and optimizing campaigns and securing systems)

5. Sharing Data with Clients

When a candidate responds to a campaign for a specific client, we share the candidate’s data with that client so they can make contact.

Following transfer, the client processes the personal data as an independent data controller and is responsible for compliance with GDPR, including informing candidates, retention periods, and maintaining a lawful basis for further processing.

6. Processors & Service Providers

We may use technical service providers (processors) for hosting, analytics, communication, or platform functionality. Appropriate agreements are concluded with processors where required.

7. Retention Periods

We do not retain personal data longer than necessary for the purposes for which it was collected, unless a longer retention period is legally required. Data will thereafter be deleted or anonymized.

8. Security

We implement appropriate technical and organizational measures to protect personal data against loss, misuse, unauthorized access, alteration, or disclosure.

9. Rights of Data Subjects

You have the right (subject to applicable conditions) to:

• access

• rectification

• erasure

• restriction of processing

• data portability

• objection

• withdrawal of consent (where applicable)

You also have the right to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

10. International Transfers

Job Heroes may be used globally, with a current focus on the Netherlands and Belgium for these pages. If personal data is processed outside the EEA, appropriate safeguards (such as Standard Contractual Clauses) will be implemented where necessary.

11. Changes

We may amend this Privacy Policy from time to time. The most current version will always be available on this page.
